Property Division

Aside from child custody, Division of Property can be one of the most contentious and complicated issues to settle in the course of a divorce. Coming to a property settlement agreement is never easy. Ownership rights depend greatly on the state the couple resides in and whether or not that state is a Community Property or Non-Community Property state. Division of property can be decided with an agreement between the two parties, via a property settlement, or by judicial decree.

Equitable Distribution of Property

As non-community, or equitable distribution, states, Kansas and Missouri courts will attempt “fair and reasonable” distribution of marital property. In a non-community state, “fair and reasonable” may or may not result in a 50/50 split of property. Factors that are considered may include (but are not limited to):

  • Duration of marriage
  • Age and health of parties
  • Income and earning ability of both parties
  • Debt and liabilities of each spouse. May include (but not limited to):
    • Mortgage
    • Car loans
    • Bank loans
    • Business loans
    • Home improvement loans
    • Unpaid bills
  • Value of marital property
  • Who is primary caregiver of children
  • Contribution of a spouse to their partner’s higher education or job advancement opportunities during the course of the marriage
  • The relative disadvantage of each spouse after divorce
  • Services as a homemaker
  • Tax consequences
  • Waste and dissipation
  • Fault
  • Premarital agreements
